This is an article from last March when Natasha Halfer was excommunicated. The authors write about how it the rules for excommunication trials set out by JS in D&C 102 was pretty unusual at the time, and was more concerned with "equity and justice" (words in the section) that other Protestant churches of the time.

The plaintiff and defendant were both allowed to testify. Half the High Council could be assigned to speak on behalf of the defendant, It sounded like in the early church, local members could vote on the verdict in a disciplinary council.

The authors went into how the Halfer trial and some other recent trials played fast and loose with the safeguards that were supposed to be part of church trials.

This might be of interest to legal beagles, and folks interested in early church history and practice.

....and my bet is that (BS artist/ con man/ Swindler) MORmON founder Joseph Smith was concerned with maintaining "equity and justice" back then just like Smith was concerned with avoiding adultery when Smith concocted and wrote up his D&C Section 132 MORmON "scripture" (BS) as a supposed divinely granted license/ mandate (EXCUSE!!!!!) for his personal debauchery and wife collecting/ MORmON harem building that Smith was going to directly attribute to (blame on) God.
......just like the Book of MORmON church has always been concerned with "the Truth"......... whatever it has to be in order to try to save the reputation of "THE" (Book of MORmON) church and its (utterly corrupt) divinely appointed leaders.

Back when Joseph Smith wrote the rules of excommunication trials, you could hold a kangaroo court in private and nobody would believe what the excommunicated person reported about his trial. After-all, he had just been excommunicated. Who would believe an excommunicated person said about the process anyway? These days, it's virtually impossible for church leaders to know whether or not you've got a hidden tape or video recorder on you or not.

There have been so many audio and video recordings made and that are available on Mormon Stories and other places on the web right now, that secret video recording of your excommunication and playing it back for the world to see is becoming more common now. The church leaders and their kangaroo court processes are quite embarrassing to both the church itself, and also to the individual church leaders who were involved in doing the excommunicating. One thing is clear: it's no court of love. The church leaders get paranoid. Without any real discernment, they are afraid of being humiliated as their face and words might be going out on the world wide web.

Mike Norton (New Name Noah) borrowed someone else's identity as he went in to interviews as someone else (a new member of the ward) and Met with his Bishop and second counselor to the Stake President and video recorded both of these church leaders faces as they interviewed him for a temple recommend. Then he called the Counselor to the Stake President back and recorded that phone call also. In that call he explained his fraud and his resulting visits to the temple where he also video recorded several of the ceremonies there in the temple also. Then in the phone call afterward, he asked the Counselor where his discernment was and he asked the Stake Counselor if he (the counselor) has a masterbation problem because the man lacked the discernment enough to issue the temple recommend to him while he impersonated someone else and lied the whole way through the interview, all done on audio and video recording (except the phone call which was audio only). I would be afraid if I were them, too.

Humiliating your Bishop and/or Stake President on the www is becoming more of a sport these days. But New Name Noah tops them all. Even John Dehlin lied on tape when his Bishop asked if he had any recording devices and he said "no" in the actual recording.

My only regret about resigning from the church (almost thirty years ago), is that I didn't have access to a small enough recording device back then to get my resignation meeting with the Bishop, on tape.
