Judge Sinclair is having a hard time getting any work done. He is thwarted at every turn.

"The first case taken up, that of McNeil against Brigham Young, for false imprisonment, was found to be ended by McNeil being murdered by the Danites. The next case, one of murder was rendered abortive by the Mormons having run off the main witnesses. The third case, which was against the two Mormons charged with forging government drafts, came to a stop because the main witness John Wallace, sent a letter to the judge, dated Camp Floyd, saying that he'd been warned that, if he came to Salt Lake City to testify, he would be murdered."

When the justice system has been corrupted, do you have any avenues left?

In February 1851, Madison D. Hambleton stands trial before "Judge" Heber C. Kimball, for killing a man named Vaughn. Hambleton shot him while they attended a Manti church service. The 39 year old Hambleton claims the 22 year old Vaughn has seduced his wife, Chelnecha, age 40.

In ruling on this case Heber C. Kimball invents MOUNTAIN COMMON LAW. Heber rules that under mountain common law, adultery is worthy of death and Hambleton is justified. Hambleton is acquitted and his wife is excommunicated.

I'm still trying to research the case, to see if any evidence of adultery was even introduced. Is this just a case of taking the priesthood holder's word? Does the fact that the victim isn't Mormon play a role? Does having Brigham Young himself act as Hambleton's attorney prejudice the whole hearing?

Liars and murderers, looks like. Of course, your average TBM would call it part of the huge conspiracy to defame and discredit those sweet, pious Utah Pioneer Saints. It was the adversary's work, for sure.
