Now the mormon church's attorneys seem to be inserting themselves into the case. It is just getting so weird!

Remember written and published church policy is for all members to contact the church before giving any statements to law enforcement, testifying at trial or being involved in any way with a legal case where the church might be mentioned.

Oh, my. There was a whole lot of overstepping going on there. The clinician was in the wrong as well. Which attorney or firm Vallow gets counsel from is not the clinician's concern. But this is Idaho, so perhaps no one will care very much.

I think both the prosecution and the defense will care a LOT. Neither side will want the church influencing testimony or evidence, and both will recognize that the church is not on their sides. Conversely, the prosecutor may want to appease the church to improve his own career prospects.

There could be an ethical violation here on the part of McConkie. That a senior partner would even talk to Vallow says that the church is paying close attention and perhaps wants an opportunity to intervene even if only indirectly. Interestingly, since McConkie is not her retained lawyer, he is not covered by attorney-client privilege and may be deposed.

It's possible that the clinician too has contravened his/her profession's ethical code. Therapists are not supposed to represent outside interests, which appears to be what has happened in this episode.

Wouldn't it be interesting to know how N.C. got the idea? Odd but it sounds like she was put right through. What is not odd is that LDSInc wants control of this thing.

On the local news here in SE Idaho a few weeks ago, there was a big story about how they were trying to move the trial to Ada County on the other side of the state (Boise). Their reason was that a letter from the leader of the LDS church might influence jurors. Why on earth would the church write a document about this? I'm having flashbacks from the Hofmann fiasco.

The church is doing their best to keep weird details of Mormon beliefs out of the public courtroom. Would Mormons protect the church first? IMO, yes. It's not really about getting a fair trial. It's probably about keeping any Mormon authorities from having to take the stand.

I think in this instance, with the national press focused on Mormonism and its role in the murders, the church will want to persuade the defendants not to claim religious inspiration or religious justification altogether.

Look for a plea deal so the case never goes to trial. Same thing that happened in the Hofmann case. Must avoid public testimony of the weird underbelly of Mormonism.

This is what I am thinking too. The last thing LDSInc wants is to drag all this crazy through a trial that will be heavily covered by the press. They will pull every string they can to keep the whole thing as quiet as possible. Getting control of the killers would go a long way towards helping with that.
