This is State To State BINGO, just like the electoral 'system', it has no place in our society where communications, travel, and mobility have homogenized our culture/society.

It seems like the culture wars are tearing individuals & families apart;

That poor child. At least the medical providers in both states worked together to ensure that she could get her abortion.

I hope that all of the women who have to travel out of state for an abortion are mindful of who is on their side when it comes time to vote.

Be aware that some States will add to their laws to prosecute those who go out of State for an Abortion. They will make it a criminal act - or try to.

And that will trigger another constitutional crisis.

Generally states cannot impose their laws on people doing things in other states. If fireworks are legal in Idaho but not in Utah, Utahns can't be prosecuted for buying and lighting them in Idaho. The new abortion laws should in theory and custom be treated the same way.

But this supreme court has already violated so many constitutional norms that there's no saying what it will do now.

What you say is, in this bizarre new world, a real possibility.

The biggest problem might be for the physicians in anti-abortion states who make the referrals to providers in other states which allow abortions (which is what happened for this ten year old.) As you pointed out, there really should not be a problem with it, but given this nutty Supreme Court, all bets are off.

Re: states are passing laws to make abortion illegal in their state AND to make it illegal to go outside the state for an abortion.

Regarding this, I heard an explanation of the legal reasoning. “Pro-Life” fanatics believe the embryo is a “person” and therefore if you take that “person” across state lines and remove it from your body then that is taking a person (a minor) across state lines to commit a crime.

What if you get a documented spiritist to attest that the fetal person agreed to it?

And there's the issue of how is the State going to know that a fetus is being smuggled out?  It would be extremely costly to have the borders sealed, and not allow any ovulating female to leave the state without first being 'inspected'.  So probably cheaper to have a law passed that no ovulating females can leave the state, period.

No, wait!! A woman can leave the state only if she's having a period!!!

I really would have made a good despot!

If an embryo is a person, then a pregnant woman should be allowed to drive in HOV lanes without being fined.

I wonder if the Texas Highway Patrol would be OK with that. Would they have to carry ultrasound machines in their vehicles to ensure that she is indeed pregnant?

Last I heard you can move to another state whenever you want.

Get a Airbnb in another state for a month, move there. then decide you want to return the following month. Problem solved.

It's not clear that would work.

The TX law, which SCOTUS allowed to stand, permits Texans to sue anyone who participates in an abortion in any state. Other conservative states are likewise enacting laws that would prevent interstate travel for purposes of abortion, and the GOP has proposed national laws that would do that too.

We can hope your suggestion works, but in the immediate term anyone who follows it is opening her/himself up to a lot of potential liability.

Fugitive slave act.

Distinquishable on two grounds.

First, those acts were passed by the national Congress and not by states.

Second, they were explicitly based on the principle in the constitution that slaves were personal property. There is nothing in the constitution that says pregnant women or their fetuses are "property."

The more likely analogue, I'd think, is the Mann Act. But that would require a federal law saying that abortion is an immoral purpose. If the Star Chamber of the United States takes its own Dobbs decision seriously and abortion truly is a states rights issue, that would be unconstitutional.

So once again we are at the mercy of a handful of sage kings and queens who legislate not political conservatism (respect for the constitution and personal liberty), judicial conservatism (stare decisis), but cultural conservatism (evident to all).

It's the 21st Century, and we are going to have to smuggle people across state lines our out of the country for medical treatment.

This story is just horrifying.

"Pro Life" means more support for pro-rape and forced birth than sensible decisions women should be able to make for themselves. It will hit minority and poor girls harder than everyone else too, who can't find a way to travel.

I. Can't. Even. with some of the barbaric decisions resulting from the pro life anti-women states.

Be careful what you wish for, pro life folks. Your daughter could be a victim of rape or incest too.

Forcing a young girl to bear a child is like raping her for life.

You really must be far gone and living in a world of conspiracy theories and lies.

There's no cabal, there's no sex slave colony on the Moon or Mars, there's nothing going on at Comet Pizza except pizza, or the Illuminati, and the secret group from "The X-Files" is fiction.

We're talking about a ten year old child. A rape victim. Give it a rest.

I wasn’t trying to be funny and I don’t subscribe to conspiracy theories, especially QAnon theories, so you’ve got me completely wrong.
I know it’s a 10yo, but last time I checked, you could still buy Plan B on Amazon, which still delivers to Gilead.

Yes, I was referring to TFG, who got what he wanted, thanks to the opposition rolling over and playing dead when Mitch refused to allow Obama to appoint Merrick Garland to the SCOTUS, then did it again when RBG died two months before TFG lost the election.

The opposition needs to grow a spine.

This would be a horrible situation were it true, but it may not be in this case. Pro-lifers will use "fake news" stories like this one to discredit any reports of the hardships caused by the new abortion environment we all find ourselves in. If this is in fact fake, the story will not serve its intended purpose. Media manipulation is not helpful right now.

I got my menstrual period at ten years of age (the summer after 4th grade.) It's not highly unusual. And as a teacher, I've known of a number of middle-school girls, aged 12 and up, who have gotten pregnant.

The youngest birth mother on record was 5 years, 7 months old. She suffered from a medical condition known as precocious puberty. There were a couple of others at 6 years, and numerous examples of 8 and 9 year olds getting pregnant.

https://en.wikipedia.org/wiki/List_of_youngest_birth_mothers

Personally, after the Covid vaccine denial, after "the big lie" about the most recent presidential election, etc., I no longer give the least amount of credibility to anything the conservative media says. There is a price to be paid for lying.

My mom got her first period at ten. My MIL got hers at 9.

And that article does not come from a very credible source, while there have been a number of cases of very young girls getting pregnant.

Like summer said… precocious puberty is a real thing. So are rapey males.

That's why you should check for yourself and not hype up things that faux wants to be fake.

Although the name of the girl can't be released, the name of the doctor is:
The IndyStar reported that Caitlin Bernard, M.D., an Indianapolis-based obstetrician-gynecologist, was contacted by a child abuse doctor in Ohio who told her about the patient and asked if she could help.

This doctor exists and is affiliated with the local university. The article you attached seems focused on attacking her character. It seems fishy to me.

Funny how ALL the other media outlets seem to have been able to verify it except for the side you support. I'd need more proof for your claim.

Edited to add omitted sentence.

Right. When I want reliable, solid information, I bypass professional news organizations and go straight to Twitchy. /s

Twitchy was started by Michelle Malkin and, as one might expect just from that, is a hyper-partisan RW website.

There's no law preventing pro abortionists to create go fund me campaigns to pay the travel expenses for people wanting abortion, if folks are so adamant about this issue then they can pay for it. But no what they really want is to control the rest of us, But most people in Red states would rather federal money to go to roads and bridges not to Contraception abortion or sex therapists for kids.

Maca, please let us all know the next time you are forced to travel out of state for needed medical care. We will wait for you to do that.

If you don't think that birth control should be subsidized, then let us know when Viagra is no longer offered for men. And I will need citations for how the Federal government is subsidizing abortions or "sex therapists for kids."

Maca, your whole attitude smacks of "it sucks to be you." For your next incarnation, please put in a request to be reborn as a woman -- preferably a poor, black woman. You might learn something.

There is no law preventing anyone who does not want an abortion from not having one.

Plus the Hyde Amendment forbids the federal government from spending any money on abortions.

Or maybe by federal funds for contraceptive abortion, you mean that you oppose IUDs. What a mensch you are.

Not so fast.

https://en.m.wikipedia.org/wiki/Hyde_Amendment#Joe_Biden_(2019%E2%80%93present

In U.S. politics, the Hyde Amendment is a legislative provision barring the use of federal funds to pay for abortion, except to save the life of the woman, or if the pregnancy arises from incest or rape.[1][2] Before the Hyde Amendment took effect in 1980, an estimated 300,000 abortions were performed annually using federal funds.[3]

During the 2020 presidential campaign, Joe Biden reversed his previous support of the Hyde Amendment and pledged to work to overturn it if elected.[35] In 2021, he introduced a 2022 budget that completely omitted the Hyde Amendment.[35][36]

A Labor, Health and Human Services bill unveiled in 2021 excludes the amendment.[37]

Silly boy. You think other people's rights are an imposition on you rather than a defense of your own.

Keep in mind that the NY Post is a Murdoch property. It asserts that the Washington Post acknowledged that the story is "highly dubious" when the WaPo said no such thing – the "highly dubious" is the Post's Murdoch spin.

The WaPo did attempt to fact-check it. The paper acknowledged that it is a one-source story (although the source is known and has spoken on the record) and that its nature makes it "very difficult" to corroborate independently.

Ohio's Attorney General says there is no victim that he's aware of, and he would know as his office runs the state's crime lab. The days go by and the story looks increasingly like it was fabricated for political purposes. Disclaimer: I am strongly pro-choice, but also pro-truth in media. Shenanigans like this have a way of backfiring.

Sadly, I'm asking myself if rapes will now go unreported in anti-abortion states (I'm sure that many are unreported as it is, for various reasons.) I think it likely. Whether that has any bearing on this particular case, I don't know.
