I don’t know how to post a link to Rexburg news. Using an iPad.

I hope this is the news about the children and whoever the remains are gets justice. I am surprised that yahoo and msn are not reporting this.

Anyone in the area able to confirm?

I wonder what the church’s response will be

I just saw he was arrest a mile form his home and there are police at his house.

There are several YouTube videos and one from an Idaho news station saying it started at 7:45 am Rexburg time. FBI and police doing several digs.

That is why I posted wondering if anyone close by has better info.

If by church response, you mean are they going to excommunicate Chad D for the murders, no, IMHO. Nor should they. They will express condolences for the children, if their remains are found, and let the justice system take its course. If Daybell is convicted, he then will be excommunicated.

Of course he could be exed for something else, and perhaps already has been. A church really can't excommunicate someone for a crime before it is adjudicated. It would be used by the defense to argue that the jury had been prejudiced by the church's action.

Anybody remember when Mark Hofmann was exed? Was it after his trial?

Does anyone seriously think that a Mormon, accused of a crime in Rexburg, ID, for God's sake, and excommunicated for said crime prior to trial, would not be able to appeal a conviction arguing biased jury?

the juries job doesn't include considering after-the-fact mitigation(s).

whether or not an accused has been exd (in a murder case) isn't evidence of culpability for his/her actions.

NOT being a matter of evidence, the jury

a) wouldn't know about whether or not an accused was exd

b) IF it did leak to the jurors, they wouldn't be able to consider it yes/no, up-down.

of all these possibilities, I say the most likely to happen

IF there was a jury (not all cases do!),

IF the jury considered him being a member and/or being ex'd ... at least one juror would alert the judge & a mistrial would (might) be granted before a verdict is entered.

No. In the vast majority of cases the exposure to media accounts and other potentially prejudicial bias are uncovered in pretrial motions and jury selection. That is much cheaper financially and in terms of judicial and juror time and energy than aborting a trial midway through.

My stmnt referred to cases under consideration by a jury.
I do agree that ideally the voir dire eliminates biased / unqualified jurors.

I'm betting that fewer than 5 % of all cases Nationwide are granted a change of venue.

Moot point. According to mormons all over the internet, Chad Daybell was excommunicated years ago and he and his beliefs have nothing to do with mormonism.

There is an interview on YouTube of the mayor saying it was the children. Then he says oops, he wasn’t supposed to say. The reporter put it on YouTube instead.

So sad. I wonder if Chad made a deal to put it on Lori? I guess time will tell.

It seems to me it would take a really cold person to keep saying the children are safe when you know they are buried in Chads yard. And to make things worse, Chad had his children still living at that house. How utterly cruel and disgusting.

Of course all above is allegedly.
